DuhDeal Terms of Service
Operational draft — this should be reviewed by qualified counsel before DuhDeal handles live marketplace transactions.
1. Marketplace role
DuhDeal provides technology that lets users list, discover, buy, sell, message, make offers, and arrange trades involving physical goods. Unless DuhDeal expressly says otherwise, DuhDeal is not the buyer, seller, owner, manufacturer, shipper, or guarantor of user-listed goods.
2. Account responsibilities
Users must provide accurate account information, protect their credentials, use the service lawfully, and be responsible for activity performed through their accounts. Users may not impersonate another person or use DuhDeal to facilitate fraud, harassment, theft, or other unlawful conduct.
3. Listings and prohibited items
Sellers are responsible for truthful descriptions, lawful ownership, pricing, condition, photos, intellectual-property rights, and fulfillment. Illegal, stolen, counterfeit, unsafe, recalled, restricted, or otherwise prohibited items may be removed and accounts may be restricted or terminated.
4. Transactions, payments, fees, and refunds
Payment processing and seller onboarding may be provided by Stripe or other approved payment providers. DuhDeal may charge marketplace, protection, or other disclosed fees. Refunds, chargebacks, disputes, taxes, shipping, and payment-provider rules may affect a transaction.
5. User-to-user risk
Users are responsible for evaluating listings and counterparties. DuhDeal cannot guarantee that every listing is accurate, every user will complete a transaction, or every item is safe, lawful, authentic, suitable, or delivered as expected.
6. Safety and enforcement
DuhDeal may investigate reports, remove content, restrict features, suspend accounts, preserve records, or cooperate with lawful requests when reasonably necessary to protect users, the marketplace, payment systems, or legal rights.
7. Service availability
DuhDeal may change, interrupt, or discontinue features for maintenance, security, legal compliance, or product development. No uninterrupted or error-free operation is guaranteed.
8. Limitation of liability
To the maximum extent permitted by applicable law, DuhDeal is not responsible for indirect, incidental, special, consequential, or punitive losses arising from user conduct, user-listed goods, third-party services, or use of the marketplace. Nothing in these terms excludes rights or liabilities that applicable law does not allow to be excluded.
9. Electronic records and signatures
By selecting agreement and typing a legal name where requested, a user consents to electronic records and signatures for DuhDeal agreements. DuhDeal may record the agreement version, typed signature, acceptance time, and limited technical information needed to maintain an audit record.
10. Policy updates
DuhDeal may update these terms and related policies. When a material new agreement is required, account features may be restricted until the user reviews and accepts the current version.
